Mark Solheim and Marcus Sanborn obtain summary judgment in high profile rape/murder wrongful death claim

Larson King trial lawyers Mark Solheim and Marcus Sanborn were recently successful in obtaining summary judgment in a high profile general liability claim asserted against a metropolitan foster care operation. The case arose out of a foster child’s July 2000 rape and murder of an 18 year old woman. In the criminal case, the foster child was tried as an adult and convicted of first degree murder and is currently serving a life sentence. In the wrongful death claim, the decedent’s parents alleged that the foster parents had knowledge of the perpetrator’s dangerous propensities and that they should have taken further action after the foster child walked away from the home the day before the murder. The court, in dismissing the claim against the foster care providers, ruled that the care providers had no duty to the decedent and that the conduct of care providers was too remote from the heinous rape and murder to be considered its proximate cause.
