Patrick Boley publishes Excess Insurance: Rights and Obligations article for DRI's For The Defense

06/09/2010

Excess insurance is playing an increasingly prominent role in the resolution of liability claims. The continued growth in jury verdicts, the rise of mass torts, the development of intricate layered corporate liability insurance programs, and the marketing of personal umbrella policies are among a variety of factors pushing excess liability insurance to the fore. In his article Excess Insurance: Rights and Obligations, partner Patrick Boley discusses a variety of important issues arising under excess liability insurance policies, including: exhaustion requirements and methodologies; the effect of underlying insurer insolvencies on excess insurance; and the rights and obligations of excess insurers in handling claims. The article appears in the May 2010 issue of For The Defense, a publication of the Defense Research Institute. View a copy of the article here.
