A disability and retaliation case handled by Larson • King partner David Wilk was highlighted in the June 24, 2009 issue of BNA's Employment Discrimination Report. The article, Eighth Circuit Panel Finds ERISA Preemption Where Plaintiff Deleted Claim After Removal, discusses the case in which a truck driver claimed that his employer interfered with his right to pension benefits by terminating his employment after he became unable to perform his regular duties. The employee also alleged disability discrimination, reprisal and fraud. The panel affirmed the district court's summary judgment on all of the employee's claims.
