Appellate team obtains favorable Minnesota Supreme Court decision on behalf of a local contractor

Paula Vraa, Jennifer Young and David Wilk recently obtained a favorable decision from the Minnesota Supreme Court on behalf of a local contractor.  The opinion, written by Justice Christopher J. Dietzen, holds that the contractor’s employees were not third-party beneficiaries of the construction contract between the contractor and the City of Minneapolis.  As a result, the employees did not have the right to sue their employer for what they perceived to be a breach of the construction contract.  The employees’ other claims, under the Minnesota Payment of Wages Act and for unjust enrichment, were dismissed as contingent on the third-party beneficiary claim.  The full opinion can be found here.
